Supreme Court refuses to withdraw order for women’s entry in NDA entrance this year

The Supreme Court has refused to withdraw its order allowing women in the NDA entrance this year. The Supreme Court has said that the Armed Forces are capable of dealing with the emergency situation, we cannot postpone the entry of women in NDA for one year. The Supreme Court rejected the contention of the central government in which the central government had said that the order of the top court allowing women to sit in the NDA entrance this year should be withdrawn.

Armed Forces are capable of dealing with emergency situations
A bench headed by Justice SK Kaul of the Supreme Court appealed to the Defense Ministry to withdraw the order in which women were allowed to sit in the next NDA entrance. The next entrance is to be held on November 14. The Supreme Court refused to withdraw its interim order. It was said by the Defense Ministry that women should not be allowed in the current entrance exam because all the mechanisms are yet to be prepared from the parameters of training and it will take time till May 2022.

Supreme Court’s strict stand
During this, counsel for petitioner Kush Kalra argued that there are two exams every year and if women are allowed to sit in May 2022, it will mean that women will be admitted in 2023. The Supreme Court said that the entry of women in the NDA cannot be postponed for one year.

The Supreme Court said that the Armed Forces are capable of doing emergency deals, so they should come up with some quick solution so that women can be ensured in the NDA immediately. The court said that the rights of women cannot be denied. We don’t want to falsify women by giving them assurance of entrance exam in November and tell them that their exam will be taken later.

During the hearing, Additional Solicitor General Aishwarya Bhati, appearing for the Defense Ministry, said that a mechanism would be prepared for the admission of female candidates. Under this, there will be a method of induction and training of women. The DG of Medical Services and the expert body will decide the medical standards for the admission of female candidates to the three defense services.

Central government argued
For this, the criteria for training will be decided according to their age, young age, nature of their training and operational and functional requirement of Navy, Air Force and Army. Curriculum and parameters will be decided for outdoor training. The infrastructure for women to live will also have to be decided, for this it will take time. All this will be completed by May 2022. In such a situation, women should not be kept in the upcoming NDA exam i.e. the entrance exam of November 14. The bench of Justice Kaul said that we do not understand that the Armed Forces will not be able to deal with this situation. Instead of taking the stand you are taking of not keeping women in the upcoming entrance, you need to think about them.

Defense Ministry will meet UPSC and take steps regarding revised notification
The top court said that we have read your affidavit in detail, we appreciate your effort, you have said other things from fitness test, curriculum but we cannot accept the request to postpone the women’s entrance test for this year . Women are looking forward to the November exam. We don’t want to end it. Don’t ask us to take your order back. The Armed Forces deal with an even more difficult situation. We are sure that she will find a way out in this matter as well.

Hearing adjourned till January
The result is to come after two months of the exam, so we keep the petition pending and the hearing is postponed to the third week of January. During this, the Defense Ministry is asked to meet UPSC and apprise them about the parameters so that UPSC can issue a revised notification regarding the inclusion of women in the November examination. Earlier, it was told by UPSC that it has not been able to issue the revised notification, it is waiting for the instructions of the Defense Ministry. The Supreme Court said that the ministry should take necessary steps for this. The Supreme Court finally said that this is a phase of change and we cannot postpone the change. This exam may not give the best result but we are looking at the future.

We would not like to take back our orders…the matter is pending
The Supreme Court in its order said that the Defense Ministry has pointed out some problems. Actually she is saying that no jam today jam tomorrow. The top court said that it is difficult for us to accept this. The Armed Forces deal with very difficult situations, whether it is the matter of the border or the matter of internal security of the country, they deal with both the emergency very well and this is part of their training.
