Kerala News: Freedom of woman to decide pregnancy cannot be taken away: Kerala High Court

The Kerala High Court said that a woman has the freedom to take a decision regarding her pregnancy and it cannot be taken away from her. Along with this, the court also allowed a mentally retarded woman of 22 weeks’ pregnancy to abort her due to deformity in the fetus.

The court said that if there is a danger of deformity in the child to be born or there is a possibility of him becoming disabled, then the court also recognizes the right of the mother to get an abortion in that situation.

The medical team gave this report
In this case the woman is marginally mentally weak. The medical team that examined him has reported that the fetus suffers from Klinefelter syndrome (a genetic condition in which the born boy has an extra X chromosome). Because of this, many complications will arise in him after being born.

The court gave this decision on a plea by the woman and her husband, who had sought permission for termination of pregnancy at 22 weeks on the ground of potential danger to the mother.
