GST Council meets:In the 53rd meeting of the GST Council, railway platform tickets, waiting room and dormitory accommodation, battery-operated car services have been excluded from the scope of GST. Now there will be no GST on such facilities. In this meeting, it has been recommended to fix a uniform rate of 12 percent on milk cans and carton boxes. During this, many big decisions have been taken. After the GST Council meeting held on Saturday, Finance Minister Nirmala Sitharaman gave information about the decisions taken in it in a press conference.
Finance Minister Nirmala Sitharaman said on Saturday that the central government’s intention has always been to bring petrol and diesel under the ambit of GST and now the states have to come together and decide its rate. She said that former Finance Minister Arun Jaitley has already made a provision to include petrol and diesel in the GST law. Now the states just have to come together and discuss to decide the rate. Sitharaman said that the intention of the GST Council was to bring petrol and diesel under GST. Now the states have to decide the rate. The intention of the late Finance Minister Arun Jaitley was very clear, we want petrol and diesel to come under GST. When GST was implemented on July 1, 2017, more than a dozen central and state levies were included in it. However, it was decided that 5 items – crude oil, natural gas, petrol, diesel and aviation fuel (ATF) would be taxed later under the GST law.
Sitharaman said that while implementing GST, the intention of the central government was to bring petrol and diesel under GST after some time. She said, “Provision has already been made to bring it under GST. Now it is just to decide that the states agree in the GST Council and then decide what rate they will be ready for. Sitharaman told reporters after the 53rd meeting of the GST Council that once this decision is taken, it will be included in the Act.
The Finance Minister also informed that platform tickets, waiting room and waiting room facilities, battery operated car services of Indian Railways are being exempted from GST. The GST Council has exempted hostel accommodation services outside educational institutions up to Rs 20,000 per person per month. However, the condition will be that the student has to stay in the hostel for 90 consecutive days. Apart from this, the GST Council has recommended waiving interest on penalty on tax demand notice.
The GST Council has recommended a uniform rate of 12% on all milk cans. This rate will be applicable for steel, iron, aluminium and any other material used.
The council has also recommended setting a uniform GST rate of 12 per cent on all carton boxes. The Finance Minister said that this will especially help apple growers of Himachal Pradesh and Jammu and Kashmir.
The GST Council has reduced the GST rate on solar cookers to 12 percent. The Finance Minister said that the 28 percent GST review on online gaming was not discussed in the 53rd GST Council meeting
In the press conference, the Finance Minister said that the rate of 12 percent will be applicable on all types of sprinklers including fire sprinklers.
To reduce government litigation, the GST Council has set a monetary limit for filing appeals by the tax department before various appellate authorities. Union Finance Minister Nirmala Sitharaman gave this information on Saturday. After the 53rd meeting of the GST Council, she said that it has recommended fixing a monetary limit of Rs 20 lakh for the GST Appellate Tribunal, Rs 1 crore for the High Court and Rs 2 crore for the Supreme Court. If the monetary limit is less than the limit set by the GST Council, the tax authority will not usually appeal. She said that the Council has also recommended that the maximum amount of pre-deposit for filing an appeal before the appellate authority be reduced from Rs 25 crore to Rs 20 crore for CGST and SGST.
