Explained: 75 percent reservation in private sector in Haryana, what are the rules, who will come under the purview, why do companies have tension?

The Haryana government has issued a notification for the 75 percent reservation in private jobs. From January 15, 2022, this rule will be applicable in the entire state. According to the notification issued by the state government, private companies, societies, trusts and partnership firms of the state will come under the purview of Haryana State Local Candidates Employment Act 2020. The Haryana government had announced reservation in the private sector in March this year. A bill related to this was passed in the state assembly in November last year. The bill was approved by the Governor on 2 March 2021.

Who is within the ambit of the law?
Under the new Act of the Government of Haryana, all companies, societies, trusts, limited liability partnership firms, partnership firms and any person and/or organization employing 10 or more persons will come under the purview of this Act. Some changes have been made in this law on the suggestions of industrialists.

Up to how much salary will get the benefit of reservation?
The youth of the state will get the benefit of 75 percent reservation in private jobs with salary up to Rs 30,000. Earlier this limit was up to Rs 50,000. The officers of the level of Deputy Director of Industries and Commerce Department will monitor. This rule will not apply to brick kilns. ITI pass youth will get priority in employment.

Who is the local candidate of Haryana?
The benefit of reservation in the private sector will be given to those candidates who are domiciled in the state of Haryana. They have been kept in the category of local candidates. In order to get the benefits under this reservation, the candidate will have to compulsorily register himself on the designated portal. Employers will also have to make recruitment through this portal.

Terms and Conditions of Law
Each employer will be required to hire 75% of local candidates for posts where the gross monthly salary is Rs 30,000 or less, as notified by the government. A local candidate may be a resident of any district of Haryana but the Company or the Employer shall have the discretion to limit the employment of a resident of any district to 10 per cent of the total number of candidatures.

Penalty for hiding information
Dushyant Chautala said that if any company, factory, institution or trust hides the information of its employees, then a fine will be imposed. No employee working in the private sector will be fired. Every employee with a job up to Rs 30 thousand will have to get himself registered on the website of the Labor Department. It will be the responsibility of the concerned company, firm or employment provider. Those companies which do not do so, will also be fined from 25 thousand to one lakh.

Companies in tension due to Haryana government’s decision
The protest against this decision of the Haryana government has also started. Indian industry asked the government to reconsider this law. At the same time, it was also feared that due to this rule, multinational companies would go out of the state. The industry unit argued that reservation hurts the competition. The state government may give 25 percent subsidy to industries to promote local recruitment.

The Confederation of Indian Industry (CII) reacted strongly, saying, “At a time when it is important to attract investment to the state, governments should not impose restrictions on the industry. Reservation affects productivity and ability to compete.

Another industry body PHD Chamber of Commerce and Industry (PHDCCI) said that any Indian should be allowed to work in any state of India without any restrictions. PHDCCI said, “The 75 per cent reservation will lead to exit of technology companies, automotive companies, especially MNCs, these companies with highly skilled workforce.”

What does the constitution say about jobs?
According to Article 19 of the Constitution, every citizen has the right to do any kind of job, business anywhere in the country. However, privatization of reservation in Haryana is different from this. In Haryana, 75 percent jobs of private companies will have to be given to the local people of Haryana with certain conditions. That is, if a candidate from any other state wants to do a job in Haryana, then he will have a lot of trouble here.
