MK Salim has filed a petition alleging that Lulu Mall is being constructed in Akkulam in violation of environmental laws. The court rejected the plea and said that Lulu Mall had not encroached on Parvati Puthanar or any other outlying property. The court held that the plaintiff’s contention that the construction of Lulu Mall violated the Coastal Zone Management Act was due to a misunderstanding.
The court said that the permission for the project was given after examining the required documents and added that the complainant’s argument was due to a misunderstanding. The construction did not violate the CRZ rules or the Kerala Paddy Field and Wetland Protection Act.
The court ruled that the area under construction by Lulu Mall did not fall within the scope of the Coast Guard.
SEIAA has stated that it can issue environmental permits for township and area development projects of over 1.5 lakh square meters. The Thiruvananthapuram Corporation has also informed that the building permit was issued after examining all the documents as per the Kerala Municipality Building Rules. Therefore, the High Court dismissed the petition.
